COURT CASE STUDY

Trustee privacy protects settlor in high-stakes court case

Background

Mr Vadim Schmidt sought disclosure of accounts and information in relation to two trusts set up by his father, who had died intestate. Rosewood Trustee Ltd was the trustee of the two relevant trusts. The defendant trustee argued that Schmidt was not entitled to the disclosure of the trust documents because he did not have a proprietary interest under the trust. Nor had his father been the settlor under the trust, which had been executed by Pacquerette Ltd as settlor (the nominee of Mr Schmidt).

Benefit of Trust

Trust is a high-standard legal arrangement, inheritance information does not become public records like a will, and the wealth will be kept in a legal, safe and private structure. After the establishment of a family trust, the management and use of the trust property are carried out in the name of the trustee. Except for special circumstances, the trustee has no right to disclose the operation of the family trust property to any other party.

USE CASE 1

Unrivaled privacy with the world's most exclusive card

At UTGL, we had the privilege to serve an ultra-high net worth individual. While eager to enjoy the finer things, he was adamant about maintaining complete confidentiality around his purchases and financial affairs.

By setting up a confidential UTGL trust account, he obtained a UTGL Asset Link Ceramic Black Card ("UTGL Ceramic Black") funded by his holdings. This allowed private, unlimited access to his wealth with cash-like purchasing power.

The technologically advanced card finally allowed him to experience elite luxuries. For him, and his beloved additional cardholders, our UTGL Ceramic Black Card is the ultimate luxury accessory, providing utmost discretion. At UTGL, we take pride in serving distinguished, selective clients who appreciate the unparalleled privacy our services offer. Our card and accounts cater to those who move between the shadows and the spotlight gracefully.

USE CASE 2

Safeguarding family privacy and harmony in wealth transfer

At UTGL, we recently assisted an elderly family patriarch who was deeply concerned by the inheritance fights he routinely saw tearing families apart. With a sizable estate and many heirs, he wanted to prevent similar strife.
Privacy was also critical - he feared that knowledge of the full extent of his wealth could poison relationships and stoke greed even before his passing.

Our global private trust structure provided the ideal solution. He could consolidate his worldwide assets confidentially under trust and name beneficiaries privately in a letter of wishes.

This allowed him to divide his legacy intentionally based on merit rather than perceived fairness. With terms binding and opaque to heirs during his life, there was minimal room for bitter disputes upon his death. We ensured his estate would transfer seamlessly to successors without airing sensitive details that could undermine family harmony in advance. No claims would disrupt his wishes. For high net worth clients like him, our services discretely solidify prudent estate plans tailored to their values, reducing potential for painful infighting over their life’s work.

USE CASE 3

Facilitating a life of utter secrecy for prominent figures

At UTGL, we assisted an exceptionally prominent client who wished to keep their personal life entirely out of public view and even maintain discretion from family.

While this celebrity wanted the convenience of seamless payments, they disliked any documented financial ties that could hint at their activities and relationships. Private personal affairs were paramount.

Our UTGL Asset Link credit card and Global Payment Secretary service, gave the client a dedicated team discreetly handling any invoice payments and money movements on their behalf around the world.

With no payment history or invoices in the celebrity’s name, their absolute privacy was preserved. They could live freely using trust fund maintenance without outside awareness. For public figures like this craving anonymity, our global private trust solution facilitates a client’s concealed lifestyle and allows living life to the fullest while revealing nothing.
